“Consent is not saying no,” said Equality Minister Aurore Bergé. “It’s saying yes, an explicit yes, freely, without constraint or ambiguity.”

You have to actively express consent. This is the standard in many countries now, and it's the right standard, because a person can be too scared to resist or even say no.
