Can Visa and MasterCard be sued for this censorship debacle?
-
Like, maybe not because of censorship per se, but maybe for abusing their power as an oligopoly or going against the desire of their users?

Sued for what?
Maybe game Devs could use for damages and loss of revenue but I doubt that would go far.As for the regular consumer what standing would you have?

Hmm, you got a point there.

Anyone can be sued for anything.

What's the civil liability of "going against the desire of their users" these days?
I mean, if you want to have a chat about antitrust measures in that space I'm game, but it's waaay above my paygrade and has nothing to do with this particular thing pretty much at all.

They're publicly traded. I would hope this adversely affects the stock so shareholders may have standing for mismanagement and acting against shareholder interests.

Monopoly.
Need an FTC that would support that and we l, uh, don't in a word.

I upvoted you because in an idealistic world that would be true, but shareholders only care about the money.

Cool, very free market liberal and stuff. It's just that... you don't sue companies to affect their stock. That's entirely separate from the legal system and not civil liability at all.

And... it's a duopoly. What are you going to do, stop using Visa and MasterCard?

No practically and not right now. But people could make some easy adjustments to reduce their revenues at the very least.

They are a regulated business so they have the discretion here to deny any transaction they don't like and/or is illegal.
Payment systems should operate at cost and be nationalized anyway. If you want privacy, use cash.

So how to you suggest we start using cash online? Hell there are some places now where you can't even use cash in person (my uni went fully contactless during COVID and still hasn't allowed cash again yet)

Use cash where ever you can realistically... Avoid merchants who require money changes. It ain't much...

It's a horrible situation because a boycott isn't even possible since, at least here in Brazil, I never chose my credit card company, I got whatever my bank sent me, which was Mastercard.

You boycott by using cash... as unrealistic an option as that is anywhere...

when you like how things are you dont really actively fight to keep it, other ppl actively fight to get rid of it when they dislike it, silent majority loses
